1. Acceptance of Terms

By accessing and using RandomWheel (the "Service") at https://randomwheel.com, you accept and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Content Policy. If you do not agree to these terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and RandomWheel, operated from Spain. You must be at least 13 years old to use this Service.

2. Description of Service

RandomWheel provides an interactive web-based platform that allows users to create, customize, save, and share digital roulette wheels for decision-making, games, giveaways, and entertainment purposes. The Service includes both guest access (without registration) and registered user accounts with additional features.

3. User Accounts

  1. To access certain features, you may create an account using third-party authentication services (Google, Facebook). You are responsible for maintaining the security of your account credentials.
  2. You must provide accurate and complete information when creating an account.
  3. You are responsible for all activities that occur under your account.
  4. You must notify us immediately of any unauthorized use of your account.

4. User-Generated Content

  1. Users may create custom wheels containing text, images, and links ("User Content"). You retain ownership of your User Content, but by creating public wheels, you grant RandomWheel a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content as necessary to provide the Service.
  2. You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your content does not violate any third-party rights or applicable laws.
  3. All User Content must comply with our Content Policy. We reserve the right to review, moderate, and remove content that violates our policies.
  4. Public wheels may be viewed by anyone. Private wheels are only accessible to the creator. The privacy setting cannot be changed after a wheel is saved.
  5. We may use automated systems and human moderators to review public content for compliance with our Content Policy.

5. Prohibited Uses

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Upload malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any commercial purpose without our written consent
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Collect or harvest user data without consent

6. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR) and Spanish data protection laws. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Intellectual Property and Copyright

7.1 Our Intellectual Property

You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our express written permission.

7.2 User Content - Copyright Ownership

When you upload images, videos, links, or other content to the Service, you represent and warrant that:

  • You own all rights to the content, OR you have obtained all necessary permissions, licenses, and consents to use and share the content
  • The content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
  • You have obtained consent from any individuals whose likeness appears in photos or videos you upload
  • The content does not violate any applicable laws or regulations

7.3 Copyright Infringement Reporting

We respect intellectual property rights and comply with the EU Digital Services Act (DSA), Spanish copyright law (Ley de Propiedad Intelectual), and DMCA-style takedown procedures.

If you believe that content on our Service infringes your copyright or other intellectual property rights, please report it using our contact form and include the following information:

  • A description of the copyrighted work or intellectual property that you claim has been infringed
  • The URL or location of the infringing content on RandomWheel
  • Your contact information (name, email address, and phone number if available)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

7.4 Our Response to Copyright Claims

Upon receiving a valid copyright infringement notice, we will:

  • Promptly investigate the claim
  • Remove or disable access to the allegedly infringing content if we determine it violates intellectual property rights
  • Notify the user who uploaded the content
  • Terminate the accounts of repeat infringers

7.5 Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification through our contact form explaining why you believe the content does not infringe any rights. We will review counter-notifications and may restore the content if appropriate.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RANDOMWHEEL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant the accuracy, reliability, or completeness of any content on the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RANDOMWHEEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.

10. Account Suspension and Termination

  1. We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including but not limited to violations of these Terms, our Content Policy, or behavior that is harmful to other users or the Service.
  2. You may delete your account at any time. Upon account deletion, your User Content may be permanently removed from the Service.
  3. We reserve the right to refuse service to anyone for any reason at any time.

11. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability to you.

We may update these Terms from time to time. When we make material changes, we will notify you by updating the date at the top of this page. Your continued use of the Service after changes are made constitutes your acceptance of the revised Terms.

12. Third-Party Services and Links

The Service may contain links to third-party websites or integrate with third-party services (such as authentication providers). We are not responsible for the content, privacy policies, or practices of third-party sites or services. You access third-party services at your own risk.

13. Indemnification

You agree to indemnify, defend, and hold harmless RandomWheel, its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any applicable laws.

14. Dispute Resolution

If you have any concerns or disputes about the Service, please contact us first so we can attempt to resolve the issue informally.

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with Spanish arbitration law, or through the competent courts of Spain, at our discretion.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. The European Union's General Data Protection Regulation (GDPR) and other applicable EU regulations shall also apply where relevant.

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of Spain. You consent to the jurisdiction and venue of such courts.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Content Policy, constitute the entire agreement between you and RandomWheel regarding the use of the Service and supersede all prior agreements and understandings.
